Order on Letter Request
TEXT ORDER denying 10 request to reopen this case. In a letter motion received on October 24, 2025, Plaintiff requests that the Court "reopen case," without providing any explanation for her request. See Dkt. No. 10. Plaintiff's request is DENIED. Plaintiff commenced this action on September 8, 2020, bringing claims under the ADA. See Dkt. No. 1. In an Order dated February 10, 2021, the Court adopted a recommendation to dismiss the complaint without prejudice and provided Plaintiff with thirty days to file an amended complaint. See Dkt. No. 6. The Court further explained that if Plaintiff failed to file an amended complaint within thirty days, the Court would enter judgment in Defendants' favor and close this case. Plaintiff received the Court's order, as reflected in the signed certified mail return receipt. See Dkt. No. 7. When Plaintiff failed to file an amended complaint in the time provided, on April 26, 2021, the Court entered judgment in Defendants' favor and closed this case. See Dkt. No. 8. The time for Plaintiff to reopen this case has long since passed and Plaintiff provides no explanation in the letter motion why the Court should permit this case to be reopened more than four years after judgment was entered. Accordingly, Plaintiff's motion is DENIED. IT IS SO ORDERED. Signed by U.S. District Judge Mae A. D'Agostino on 10/30/2025. (ban) Modified on 10/30/2025 (ban). [copy mailed to plaintiff]
