Order on Motion for Extension of Time
ORDER: Granting in part 43 "Motion for Extension of Time for Discovery." The court finds excessive the ninety-day extension requested to be excessive. Instead, the court will grant a thirty-day extension, as this was the interval between service of the expert report and conclusion of discovery included in the Case Management Order ("CMO") (Docket No. 34). New deadlines: Conclusion of All Discovery: October 22, 2026; Motions for Summary Judgment: December 4, 2026; Oppositions to Summary Judgment: January 13, 2026. Replies and sur-replies allowed within five business days of the motion they respond to. All other terms of the CMO remain unchanged.
