MINUTE entry before the Honorable Jeffrey I Cummings: This case has been assigned to the calendar of Judge Jeffrey I. Cummings and the Court is in receipt of defendant's motion to dismiss 8 . As is explained in the Court's standing order on motions to dismiss (available on the Court's website), the parties are advised that Marlo Barnett (as the non-moving party) has a right to amend the complaint once within 21 days of the filing of defendant's motion to dismiss under Federal Rule of Civil Procedure 15(a)(1)(B). Accordingly, Ms. Barnett is directed to review defendant's motion to dismiss and to consider exercising her right to amend her complaint as a matter of course under Rule 15(a)(1)(B). If Ms. Barnett decides to amend her pleading in response to the motion to dismiss, she shall file her amended complaint by 5/10/24 and defendant shall file either an answer or a renewed motion to dismiss by 5/24/24. If Ms. Barnett elects not to amend her complaint, but instead chooses to respond to defendant's motion to dismiss, she shall file her response to defendant's motion to dismiss by 5/17/24, and defendant shall file its reply by 5/31/24. The Court will review the parties' submissions and will either issue a ruling by mail or set a hearing if appropriate. Moreover, on or before 6/5/24, the parties shall file a joint initial status report in accordance with the template available on the Court's website under the case management procedure titled "Initial Status Report for Newly Filed Cases." The parties shall also review all of the case management procedures and standing orders available on the Court's website, including the Court's case management procedure for motions to dismiss. Initial tracking status hearing set for 6/17/24 at 9:00 a.m. to track the case only (no appearance is required and the case will not be called).
