MINUTE ORDER: Defendant removed this action to this Court on January 25, 2023. ECF No. 1. Since then, Plaintiff has failed to file a pleading compliant with the local and federal rules and this Court's orders. On November 24, 2023, the Court granted Defendant's motion to strike Plaintiff's third amended complaint but permitted Plaintiff to file a motion seeking leave to file a fourth amended complaint. At that time, the Court warned her that her failure to do so could result in dismissal of the case. To date, she has not filed such a motion. Instead, on February 27, 2024, Plaintiff submitted an amended complaint without first seeking leave to do so. The next day, the Court ordered that Plaintiff file a motion seeking leave to file that amended complaint by March 22, 2024, and warned that failure to do so would result in the Court's striking the proposed amended complaint. She did not do so. On April 9, 2024, the Court granted Defendant's motion to strike the proposed amended complaint, and ordered that "by April 30, 2024, Plaintiff shall show cause why this case should not be dismissed for failure to prosecute it." Again, Plaintiff did not do so. And over two more weeks have passed. "A dismissal for failure to prosecute may be ordered by the Court upon motion by an adverse party, or upon the Courts own motion." See LCvR 83.23. Plaintiff has failed to comply with the Court's orders directing her to file a motion seeking leave to file an amended complaint and she has failed to respond to the Court's order to show cause why her case should not be dismissed for want of prosecution. Accordingly, it is hereby ORDERED that this case is DISMISSED WITHOUT PREJUDICE for lack of prosecution. The Clerk of Court is directed to close the case. Signed by Judge Timothy J. Kelly on 5/17/2024. (lctjk1)
