Order to Show Cause ~Util - Set Deadlines ~Util - Set Hearings
ORDER TO SHOW CAUSE filed by China Hydroelectric Corp. Defendants shall show cause as to why this Court should not order, as preliminary injunctive relief, that the defendants, their officers, agents, servants, employees, affiliates, attorneys, and persons in active concert or participation with them, and granting any other relief the Court deems just and proper and as set forth in this Order. Security in the amount of $3,000 will be posted by October 1, 2012. IT IF FURTHER ORDERED that briefing and limited expedited discovery shall proceed in accordance with the schedule as set forth in this Order. The Defendants shall produce documents in response to Plaintiff's document requests on or before September 20, 2012 and concluding October 2012. The Defendants shall produce witnesses for deposition between September 25 and October 3, 2012. Plaintiff will file its Motions for a Preliminary Injunction on or before September 28, 2012; Defendants will file its opposition to Plaintiff's Motion for a Preliminary Injunction or or before October 2, 2012. Plaintiff will file its reply in further support of its Motion for a Preliminary Injunction, if any, on or before October 4, 2012 or hearing to Court. Counsel for Defendant's in New York, David Shultz at O'Melveny and Meyers, 7 Time Square, New York, NY.
