NOTICE OF PARTIAL VOLUNTARY DISMISSAL WITH PREJUDICE UNDER FEDERAL RULE OF CIVIL PROCEDURE 41(a)(l)(A)(i): Plaintiff Donna Ann Gabriele Chechele, by her undersigned attorneys, hereby gives notice under Federal Rule of Civil Procedure 4l(a)(l)(A)(i) that the action captioned above is voluntarily dismissed with prejudice effective immediately with respect to Defendant Pope Investments II LLC. Plaintiff states in her complaint that "[t]his action is brought in the right and for the benefit of China Yida, which is named as a nominal defendant solely to ensure that all necessary parties are before the Court" (Compl. [ECF No. 1] at PL. 9). In light of that statement, Defendant China Yida Holding, Co. will be dismissed with prejudice if Plaintiff does not show cause by April 1, 2015, that China Yida should remain a defendant.
