Order on Motion for Reconsideration / Clarification
ENDORSED ORDER: "Plaintiff's Motion for Reconsideration of Interlocutory Order Pursuant to Federal Rule of Civil Procedure 54(b) Regarding Newly Discovered Evidence" (Doc. 79) is denied. Plaintiff misconstrues the procedural history and Court's Orders. The Court did not exclude evidence or close an evidentiary record. Rather, the Court dismissed Plaintiff's claims against Equifax Information Services LLC, TransUnion LLC, Experian Information Solutions, Inc., Navy Federal Credit Union, USAA Federal Saving Bank, Bank of America, TBOM/ATLS/FORTIVA MC, and Absolute Resolutions Investments without prejudice for lack of service. (Doc. 38). The Court later dismissed Plaintiff's claims against Freedom Mortgage Corporation and Capital One, N.A., successor by merger to Discover Bank, with prejudice because the allegations in Plaintiff's amended complaint failed to state a claim. (Doc. 61). The newly submitted "evidence" does not demonstrate any error in these rulings or otherwise provide a basis for reconsideration. Plaintiff's remaining claim against Santander Consumer USA Inc. d/b/a Chrysler Capital remains stayed pending arbitration. Plaintiff is warned that he may be subject to sanctions if he continues to file repetitive or meritless motions. Signed by Judge Thomas P. Barber on 9/2/2026. (ANL)
