ORDER re: 32 Motion to Seal. Defendants moved to seal 33 Exhibit 14 to their Opposition to Plaintiff's Motion for Preliminary Injunction because that document was designated as "CONFIDENTIAL" by Plaintiff pursuant to the Court's standing order at ECF No. 6.
However, the standing order does not provide for automatic sealing of designated material, and "[n]o document shall be sealed merely by stipulation of the parties." D. Conn. L. Civ. R. 5(e)(3). Rather, to seal a document, the Court must make "particularized findings demonstrating that sealing is supported by clear and compelling reasons and is narrowly tailored to serve those reasons." Id.
The Court is unable to make such a finding at this time because 33 Exhibit 14 is extensively redacted and does not appear, on its face, to implicate privacy or security concerns that overcome the weight of the presumption of public access to court documents.
Out of an abundance of caution, 33 Exhibit 14 shall remain temporarily sealed. On or before July 24, 2026, Plaintiff may file a supplemental brief in support of Defendants' 32 Motion to Seal that: (1) explains the purpose of the confidentiality designation; (2) demonstrates clear and compelling reasons for the sealing of the exhibit; and (3) explains why sealing of the entire document is narrowly tailored to support those reasons.
