Order on Motion for Default Entry 55(a)
ORDER denying 22 Motion for Default Entry. The waivers of service packets sent to the defendants in this case were not returned executed, and therefore there has been no effective waiver of service (or actual service) in this action. In other words, although the waiver of service packets might have been delivered, no such waiver of service form has been signed and returned by the defendants who have yet to plead or defend in this matter. Accordingly, default may not enter. The Clerk of Court is asked to please resend Plaintiff the forms necessary to effect service of a summons and complaint by the United States Marshals Service. To that end, the court thanks the Clerk's Office and the United States Marshals Service for their efforts and care. Plaintiff is instructed to be careful in completing these forms (as is his responsibility), because it impacts how service can be effectively achieved. If Plaintiff's instructions as to service are incorrect, any further attempts at service will be Plaintiff's responsibility and at Plaintiff's expense. It is so ordered. Signed by Judge Omar A.
