Minute Entry and Order: A telephonic Pre-Settlement Status Conference was held on 7/20/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Abdul Hassan for Plaintiff and Howard Sokol and Matthew Caplan for Defendant. On consent of the parties, discussion held off the record regarding the parties' dispute regarding the non-monetary terms of the parties' proposed settlement agreement, as outlined in Defendant's motion 31 for a hearing. By 8/3/2026, the parties are directed to meet and confer and to finalize their settlement agreement in accordance with the discussion held off the record, and to file a proposed Settlement Agreement pursuant to Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015). The parties are respectfully reminded that they may file a form consenting to reassignment of this case to the undersigned Magistrate Judge for all purposes, including for review of the settlement agreement and to conduct the Cheeks hearing. See ECF 2 . Attached to this Order is a blank copy of the consent form that should be filled out, signed, and filed electronically if all parties wish to consent. ORDER: On 7/7/2026, the Court entered an order scheduling a pre-settlement conference in this case on 7/20/2026 and directing the parties to file ex parte settlement statements with the Court by 7/10/2026. Any party that has not done so is respectfully reminded to file their settlement statements with the Court no later than 7/15/2026 by 5:00 p.m. The parties may submit their respective ex parte settlement positions via Chambers email, merkl_chambers@nyed.uscourts.gov.
