ORDER OF PARTIAL DISMISSAL: Per the Memorandum and Order entered this date, the Comt grants Compass Health's 35 motion to dismiss to the extent it seeks dismissal of the client-advocacy theory under Count II (and to the extent Birchfield pleads it under Count II), see doc. 31 at, 12, that the Court previously dismissed, see doc. 29 at 9, and Count III of the Second Amended Complaint. The Court denies the motion in all other respects. The Court denies Birchfield's 33 motion for a preliminary injunction and denies as moot Birchfield's 40 motion for leave to file a sur-reply.
