Pending before the Court is Defendant's Motion to Seal Exhibit Three to Plaintiff's Motion to Compel. ECF No. 60 . On August 21, 2026, Plaintiff filed a Motion to File Under Seal Exhibit Three (3) to Plaintiff's Motion to Compel Production of Documents Regarding Prior Incidents. ECF No. 57 . Plaintiff did not establish a reasons for sealing other than citing to a stipulated protective order that, as a matter of law, is insufficient to support a sealing request. Further, the document Plaintiff sought to seal had been filed on the publicly available docket. Defendant's Motion to Seal addresses the shortcomings in the prior motion and establishes compelling reasons under Kamakana v. City & Cnty. of Honolulu, 447 F.3d 1172, 1179 (9th Cir. 2006), to seal Exhibit 3.
Accordingly, IT IS HEREBY ORDERED that the Motion to Seal (ECF No. 60 ) is GRANTED.
IT IS FURTHER ORDERED that the Clerk of Court must detach ECF No. [53-3] from ECF No. 53 and file the Exhibit under seal.
