TEXT ORDER: Pending before the Court is Defendant Ply Gem Specialty Products, LLC.'s amended motion to compel arbitration or, in the alternative, motion to stay and compel compliance with the Notice and Opportunity to Cure Act (the Act) or, in the alternative, motion to dismiss for lack of standing 21 . The motion is GRANTED to the extent this matter is STAYED until such time Plaintiffs have complied with the Act, in accordance with S.C. Code Ann. § 40-59-810, et seq. In addition, the parties shall participate in an early mediation of this matter, which they may do, upon agreement, before Plaintiff complies with the Act. The Court is of the firm opinion the excellent counsel in this matter could and should settle this matter without any further Court intervention. In the unlikely event it becomes necessary, however, the Court will adjudicate Ply Gems motion to compel arbitration. Consequently, not later than September 8, 2026, counsel shall confer, draft, and submit to the Court a proposed consent amended scheduling order for this action. Further, not later than the first day of each month, the parties shall file a joint status report until further order of the Court.
