ORDER granting the 68 Motion to Withdraw Previously Filed Motion to Stay Consideration of Plaintiffs Motion to Remand (R. Doc. 44), filed by Defendants Exxon Mobil Corporation and ExxonMobil Pipeline Company, LLC. The Motion to Withdraw asserts that the basis for Defendants' 44 Motion to Stay Consideration of Plaintiffs' Motion to Remand (R. Doc. 16) is now moot as the United States Supreme Court has issued its opinion in Chevron USA, Inc., et al. v. Plaquemines Parish, Louisiana, et al., which opinion Defendants filed into the record at R. Doc. 66-1. Additionally, the Motion to Withdraw requests a status conference to discuss the potential for supplemental briefing on Plaintiffs' Motion to Remand; however, the parties have already filed supplemental briefing into the record. Order on Motion to Expedite Order on Motion for Conference
ORDER granting in part and denying in part 91 Ex Parte Motion for Expedited Consideration of Plaintiffs' Moton to Remand, and Motion for Status Conference Before Magistrate Judge Wilder-Doomes, filed by Plaintiffs. To the extent the Motion requests expedited consideration of the 16 Motion to Remand, it is DENIED. This case was reassigned to Magistrate Judge Wilder-Doomes less than a week ago after Plaintiffs successfully sought recusal of Magistrate Judge Johnson. See R. Doc. 90. The issues before the Court in the 16 Moton to Remand are complex and the parties recently filed supplemental briefing on the impact of the United States Supreme Court's opinion in Chevron USA, Inc., et al. v. Plaquemines Parish, Louisiana, et al. on remand. See R. Docs. 86, 88, 89. Additionally, the briefing and exhibits on the 16 Motion to Remand total over 2500 pages. To the extent the Motion requests a status conference with the Court, it is GRANTED.
