Minute Order by Judge Jinsook Ohta: In Sinitsa v. CUSO Financial Services, LP et al, Plaintiff filed a notice of voluntary dismissal citing Fed. R. Civ. P. 41(a)(1)(A)(i). Dkt. 24. Fed. R. Civ. P. 41(a)(1)(A)(i) states that a "plaintiff may dismiss an action without a court order by filing... a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment." In this case, Defendant had already filed an answer prior to Plaintiff's filing, Dkt. 23, so Fed. R. Civ. P. 41(a)(1)(A)(i) no longer applies. Therefore, the Court will grant Defendant an opportunity to object to this dismissal should they wish to do so. Any objection or opposition must be submitted by October 6, 2025; otherwise, the Court will deem Defendant to have agreed to Plaintiff's voluntary dismissal pursuant to Fed. R. Civ.
