Memorandum and Order. The Court grants in part and denies in part the Black & Decker Defendants' motion to exclude the expert report and proposed testimony of Moss. The Court admits Moss' expert opinions regarding (i) causation, (ii) the DeWalt saw's noncompliance with safety standards, (iii) the availability and feasibility of a nonremovable or one-piece alternative design, and (iv) the insufficiency of the DeWalt saw's warnings. The Court excludes Moss' expert opinion concerning the availability and feasibility of an interlocked guard alternative design. The Court also denies the Black & Decker Defendants' and CVD's motions for summary judgment. Ordered by Chief Judge Margo K. Brodie on 3/20/2024. (WV)
