ORDER GRANTING JOINT STIPULATION 49 OF DISMISSAL WITH PREJUDICE PURSUANT TO FED. R. CIV. P. 41(a)(2) by Judge Fernando M. Olguin, re Stipulation to Dismiss Case 49 : The Court, having considered the Joint Stipulation to Dismiss with Prejudice Pursuant to Fed. R. Civ. P. 41(a)(2) (the "Stipulation of Dismissal") and for good cause shown, hereby ORDERS AS FOLLOWS: 1. The Stipulation of Dismissal is granted. All of Daimler Truck Financial Services USA LLC's ("Daimler") claims asserted against Vanguard National Trailer Corporation ("Vanguard") are dismissed with prejudice as to Vanguard. Further, all of Vanguard's counterclaims asserted against Daimler are dismissed with prejudice as to Daimler. In addition, CIMC Reefer Trailer, Inc., a/k/a Vanguard Reefer Trailer, Inc.'s ("CIMC") claim for money had and received asserted against Daimler is dismissed with prejudice as to Daimler.
