The court adopts the proposed protective order, dkt. 115 , as its own, with the following modification:
Section 1.b shall be modified as follows to comport with Citizens First Nat. Bank of Princeton v. Cincinnati Ins. Co., 178 F.3d 943, 945 (7th Cir. 1999), which requires the definition of "Confidential" to be objective, not subjective:
Under this Order, Federal Defendants shall have the right to identify and designate as "Confidential" any document or other information they produce as part of the Administrative Record which constitutes, reflects, or discloses confidential archeological and cultural resource information, including (1) character and location of historic properties contained under Section 304 of the National Historic Preservation Act, 54 U.S.C. §307103(a); and (2) "information concerning the nature and location of any archaeological resource" protected under Archaeological Resources Protection Act, 16 U.S.C.A. § 470hh.
