ORDER: Pursuant to the Notice at doc. 71, the parties are directed to submit supplemental briefing addressing whether the harm rescission rule has any bearing on the issues presently before the Court. The supplemental briefs shall be filed within twenty-one (21) days of the date of this Order and shall not exceed seven (7) pages.
