ORDER STRIKING 29 Motion to Compel. This motion is deficient for two reasons. First, it does not contain a handwritten signature. A handwritten signature elsewhere in the filing is not sufficient; the signature must appear on the motion itself. Second, it is not double-spaced as required by SDIL-LR 5.1(a). This is the second time that Plaintiff has submitted a filing to the Court with these deficiencies. See Docs. 7, 26. The Court WARNS Plaintiff that all future filings must be double-spaced and contain a handwritten signature. The Court also notes that the proper way to obtain evidence from a non-party, such as the Belleville Police Department, is with a subpoena. Under SDIL-LR 45.1, "[t]he Clerk of Court shall issue subpoenas to a pro se party only upon Order of the Court." The pro se party must properly complete the subpoena form, except for the date and Clerk's signature, and file a motion seeking authorization for issuance of the subpoena for the specific evidence requested. Id. The motion must address the relevancy of the requested evidence to the claims or defenses at issue. Id.
