Order on Motion to Seal Document
ORDER: Before this Court is Non-Parties Motion to Maintain Documents Under Seal (Doc. # 971 ). The Motion is GRANTED IN PART AND DENIED IN PART. The current documents filed under seal shall remain that way until September 30, 2026. The common-law right to access judicial documents does not envision the entirety of documents be placed under seal; the public and class members have a right to know about the case. The non-parties should work collaboratively with plaintiffs' counsel over the next two-weeks to partially redact documents blocking out only the truly competitive sensitive information. For example, not every word of the Schulman report contains competitively sensitive business information. The same is true for Exhibits 21, 38, 40, 45, 46, 47, 49, 57, 140, 164, and 177. "Transparency in a class action is crucial to not only the Class, but to the public's trust in the judicial system and to preserving the spirit of Rule 23." Cabrera v. Google LLC, No. 5:11-CV-01263-EJD, 2025 WL 2494429, at *4 (N.D. Cal. Aug. 29, 2025). If the parties are unable to reach a thoughtful agreement, the Court will follow United States Supreme Court precedent that starts with a presumption of open judicial records. Nixon v. Warner Commc'ns, Inc., 435 U.S. 589, 597 (1978). Signed on 9/16/2026 by District Judge Stephen R. Bough. This is a TEXT ONLY ENTRY. No document is attached. (TDP)
