Order on Motion to Withdraw as Attorney
TEXT ORDER (A) granting in part and denying in part 10 Motion to Withdraw as Counsel and Motion to Continue, in that Attorney Brian Keith Leonard is terminated as counsel of record for Plaintiff but no basis exists for a continuance, and (B) directing the Clerk to update the Docket to reflect that Plaintiff now proceeds pro se with an address for service as provided in 11 Notice. Plaintiff did not file a response in opposition to 10 Motion despite notice that failure to file any such response would result in the granting of the request of Plaintiff's counsel to withdraw. Under these circumstances (and consistent with Local Rule 7.3(k)), good cause exists to permit the withdrawal of Plaintiff's counsel. Conversely, no basis exists for a continuance. The parties have briefed 6 Motion to Dismiss and that matter is before the assigned District Judge. No further litigation will occur in this case until the resolution of 6 Motion. Plaintiff has had sufficient opportunity to secure new counsel and may use the pendency of 6 Motion to pursue that course if he chooses. Issued by MAG/JUDGE L. PATRICK AULD on 08/05/2026. (AULD, L.)
