   ORDER ON DEFENDANTS' MOTIONS TO DISMISS AND COMPEL ARBITRATION by Judge Stanley Blumenfeld, Jr.: Defendants' motions to dismiss under Rule 12(b)(1) for lack of Article III standing 287 , 289 , 292 are denied. MHI's motion to compel arbitration 286 is granted as to Plaintiff Grimmett, and his claims against MHI are stayed pending completion of the arbitration. As to all other claims, Defendants' motions to dismiss under Rule 12(b)(6) 287 , 289 , 292 are granted, and Plaintiffs' claims (other than Grimmett's claims against MHI) are dismissed on the merits with prejudice. The Court expects Grimmett and MHI to cooperate in good faith to engage in the arbitration process pursuant to their agreement. They shall file a joint report on the status of the arbitration by 1/15/2027, with a supplemental joint status report due every 60 days thereafter until they notify the Court that arbitration is complete or until further order of the Court. The Court sets an in-person Status Conference on 3/26/2027 at 8:30 AM. If the parties fail to timely file a joint report, Grimmetts claims against MHI will be dismissed without prejudice for lack of prosecution. Alternatively, if the parties wish to avoid the need for status reports and conferences, they may file a stipulation agreeing to dismiss Grimmett's claims against MHI without prejudice, which relieves the Court of the obligation to monitor the status of the case, and which the Court will treat as functionally indistinguishable from a stay in terms of their ability to seek confirmation, modification, or vacatur of an arbitration award.
