Order on Motion for Reconsideration
ORDER: plaintiff's renewed motions 7 for reconsideration and disqualification are denied for the reasons set forth in this court's February 29 order denying his prior motions for reconsideration and disqualification. The plaintiff must file his amended complaint which currently begins on page 16 of his motion as "Exhibit A" and is 198 pages long as a standalone filing with the court, labeled as his amended complaint. The amended complaint must be "a short and plain statement" of the plaintiff's claims against the NYCDOE. Fed. R. Civ. P. 8. "The statement should be short because unnecessary prolixity in the pleading places an unjustified burden on the court and the party who must respond to it because they are forced to select the relevant material from a mass of verbiage." Salahuddin v. Cuomo, 861 F.2d 40, 42 (2d Cir. 1988). Pursuant to this court's January 25 order, the amended complaint must only state claims against the NYCDOE or it will be dismissed. The plaintiff is directed to file his amended complaint by March 18, 2024, or the court shall direct the Clerk of Court to enter judgment and close this case. Ordered by Judge Eric R.
