MINUTE entry before the Honorable Manish S. Shah: Plaintiff's motions for a temporary restraining order 8 and expedited discovery 10 are granted. The court finds, on a preliminary basis, that plaintiff is likely to succeed on the merits of its claims that defendant misrepresented plaintiff's goods or services through materially false statements (e.g., that plaintiff's customers' vehicles were no longer covered or plaintiff was going out of business) that deceived customers and injured plaintiff. In addition, plaintiff is likely to succeed on its claim that defendant infringed plaintiff's trademark by using the mark without permission to suggest that defendant was somehow affiliated with plaintiff or authorized to service plaintiff's customers. Defendant's conduct damages plaintiff's intangible goodwill and the competitive harm cannot be quantified or remedied through damages. There is no harm to defendant from an injunction to cease false advertising and trademark infringement, and the balance of harms favors plaintiff. The public interest favors an injunction to prevent customer confusion and false advertising. No bond is necessary because defendant is not damaged from an injunction to stop its unlawful conduct. Enter Temporary Restraining Order. Plaintiff has good cause to conduct discovery before a Rule 26(f) planning conference because expedited discovery is necessary to develop facts in support of plaintiff's request for a preliminary injunction. The court limits the expedited discovery to 5 interrogatories, 6 requests for production, and 2 depositions, for each side. Enter Expedited Discovery Order.
