ORDER GRANTING Defendants' 14 Unopposed Motion to Stay by Magistrate Judge Susan Prose on 09/28/2026. The court is persuaded that Defendants have met the factors of String Cheese Incident, LLC v. Stylus Shows, Inc., No. 05-cv-01934-LTB-PAC, 2006 WL 894955 at *2 (D. Colo. Mar. 30, 2006), as required to show such a stay is warranted in the court's discretion. Ordinarily, this court does not stay discovery simply because a Rule 12(b)(6) motion is pending. See, e.g., Lucero v. City of Aurora, No. 23-cv-00851-GPG-SBP, 2023 WL 5957126, at *2 (D. Colo. Sept. 13, 2023). However, Plaintiffs join in the request, arguing a stay will conserve party and judicial resources and will not prejudice any party. Under these circumstances, the court exercises its discretion to stay discovery, pending the resolution of the 13 Motion to Dismiss. See Wang v. Hsu, 919 F.2d 130, 130 (10th Cir. 1990). Accordingly, the 14 Motion to Stay is GRANTED, and discovery is stayed pending a ruling on the 13 Motion to Dismiss.
