Order on Motion to Dismiss for Failure to State a Claim
PAPERLESS ORDER denying without prejudice 19 Defendant’s Motion to Dismiss. Our Plaintiff tells us that “[a]fter conferring with Defendant’s counsel, and upon Defendant’s express consent to venue and jurisdiction in the Massachusetts state courts, EDB has refiled its claims in the Massachusetts state court, sought a preliminary injunction from the Massachusetts court, and withdrawn its Motion for a Preliminary Injunction before this Court.” Unopposed Motion for Extension of Time [ECF No. 22]. Because the parties have consented to refiling this action in Massachusetts state court, the “Defendant’s primary forum non conveniens argument [has] been mooted... [and] no further purpose would be served by further briefing of Defendant’s Motion to Dismiss.” Ibid. In light of the foregoing, we DENY without prejudice the Defendant’s Motion to Dismiss. If the parties fail to effectuate the transfer of this case to Massachusetts, the Defendant may refile his Motion to Dismiss.
