TEXT ORDER denying with leave to refile 51 Joint motion for extension of time. First, the motion is not compliant with Local Civil Rule 6.01 (D.S.C.) as it does not identify the discovery (including depositions by witness name and date) that have been completed and depositions (including witness name) and other discovery remaining to be completed. The Court is concerned that this case is almost two years old and the parties are still struggling to complete discovery. The Court is inclined to deny an extension greater than 60 days unless the parties can show that they have diligently pursued discovery in this matter and, regardless of such diligence, discovery, particularly depositions, could not be concluded. The almost-two-year delay and sale of EthosEnergy's parent company are only recent barriers to discovery.
