FILED IN INCORRECT CASE. *** MEMORANDUM OPINION AND ORDER: The court holds that IBM has established beyond peradventure that Nuez did not administratively exhaust her pay discrimination claims, and that IBM is entitled to summary judgment. Having already dismissed Nuezs remaining claims on Rule 12(b)(6) motion, the court dismisses this action with prejudice by judgment filed today.
