FINDINGS OF FACT, CONCLUSIONS OF LAW AND RECOMMENDATION by Magistrate Judge Regina S. Edwards on 06/25/2026 re 25 MOTION to Dismiss. The Magistrate Judge, having made findings of fact and conclusions of law, RECOMMENDS that, should the District Judge decide to grant dismissal with prejudice, dismissal be granted without the reimbursement of Defendants Ventra Grand Rapids 5, LLC and Flex-N-Gate Logistics, LLC's attorney's fees and costs as a condition ofdismissal. The Magistrate Judge FURTHER RECOMMENDS that, should the District Judge decide to grant dismissal without prejudice, dismissal be granted subject to the following condition: As a condition of filing another action including the same claims against Defendants Ventra Grand Rapids 5, LLC and Flex-N-Gate Logistics, LLC, Plaintiff Vincent Bentley will first be required to reimburse Defendants for their reasonable attorneys' fees and costs incurred to defend against those claims in this action. Such fees and costs will be determined by that court at the time that new suit is commenced. Objections due by 7/10/2026. cc: Counsel (HMC)
