TEXT ORDER. A status conference was held on April 5, 2024, to address the parties' readiness for trial and the parties' interest in mediating this action with a United States Magistrate Judge. (ECF No. 165 ). In light of the time, inconvenience, and expense to both parties if a trial is held, the parties have agreed to and requested mediation before a United States Magistrate Judge to attempt in good faith to resolve the case. Accordingly, the court appoints United States Magistrate Judge Kevin F. McDonald to conduct and preside at a mediation in this action. The parties are instructed to contact Judge McDonald's chambers (mcdonald_ecf@scd.uscourts.gov) the week of April 22, 2024, to schedule such mediation and then to appear at the time and place determined by Judge McDonald. The parties shall participate in mediation in good faith and subject to the provisions of Local Rule 16:08, D.S.C. The parties are further advised that the trial of this case, should it fail to settle, will proceed no later than mid-July. IT IS SO ORDERED.
