Order on Motion for Miscellaneous Relief
The Court has before it the Parties' Joint Motion for Leave to Take Additional Depositions. Doc. 37. In that Motion, filed three weeks after the already-extended close of discovery (Doc. 22), the Parties seek leave to take discovery "necessary to complete" two depositions that the Parties agreed to postpone until after the mediation and thus after close of the discovery deadline. The Motion is DENIED, as it is triply flawed. First, the Parties agreed on their own to ignore the Court's deadline for discovery. Second, the Parties did so in a way likely to make the court-required mediation less effective: Mediation deadlines are not contingent on discovery, and discovery generally makes for a more informed mediation. And, third, the Parties have now come to the Court after the fact asking the Court to bless their disregard of the schedule. The Court will not do that. The Court will not bar the Parties from conducting these depositions by mutual agreement, nor from using any information obtained during them in the litigation. But the Court will not formally and retroactively extend the deadline for discovery, and will not get involved in any disputes that arise from the new discovery that the Parties decided on their own need not be taken in adherence with the prevailing deadlines.
