ORDER GRANTING REMAINING RELIEF FOR PLAINTIFF'S MOTION TO COMPEL. The Court FINDS and ORDERS as follows: at trial, the Court will (a) instruct the jury that the video at issue was not preserved, (b) read aloud a statement setting forth the circumstances of the loss of the video data and its likely relevance, (c) instruct the jury that defendants had a duty to preserve the video data but have negligently or recklessly failed to do so, and (d) tell the jury that they may give this whatever weight they deem appropriate as they consider all the evidence presented at trial.
