PAPERLESS ORDER: For the reasons discussed during today's motions hearing, the Court GRANTS ECF No. 38 and AMENDS its decision and order at ECF Nos. 35 & 36 to dismiss without prejudice the breach of contract claim solely as to Defendant IMMDF's breach of the indemnification provision as to Plaintiffs Jorge Vila and Dolovan/Bellbridge. All other claims are dismissed with prejudice. Within fourteen days from today, Plaintiffs shall file a second amended complaint consistent with this decision.
