Stipulation and Order
STIPULATION OF DISMISSAL WITHOUT PREJUDICE Plaintiff, Christopher S. Chaudoir and Defendants, Globecomm Systems, Inc. and First Reliance Standard Life Insurance Company HEREBY STIPULATE that (i) Defendants waive any right to challenge Plaintiff's original application for long term disability benefits under First Reliance Standard's group long term disability insurance policy number LID 117458 (the "Claim") on the basis that it was not timely submitted; (ii) First Reliance Standard is and shall continue to review the Claim based on additional records which have been and may be supplied by Plaintiff in the future; (iii) Plaintiff shall maintain any and all rights to pursue any available administrative review of the Claim decision; (iv) if Plaintiff pursues such an administrative review, any applicable contractual and/or statutory limitation period for litigation of the Claim shall begin on the date that First Reliance Standard makes a final decision on the administrative appeal; and (v) the above captioned lawsuit shall be dismissed without prejudice and with each party to bear his/its own fees and costs incurred as of this date.
