Order Order to Withdraw the Reference
ORDER on Defendants' Motion to Withdraw the Reference from Bankruptcy Court to US District Court: The court accepts the bankrutpcy judge's Report and Recommendation. Accordingly, the court grants Defendants' Motion to Withdraw the Reference, but only to the extent that the reference of this action will be withdrawn upon certification by the bankruptcy court that the parties are ready for trial. Until that time, the reference for the adversary proceeding shall remain with the bankruptcy court as to all pretrial matters, including the submission of reports and recommendations on dispositive matters. Further, as there appears to be no reason at this time for this action to remain open, the court, to prevent the case from continuing to age without activity, determines that it should be, and is hereby, administratively closed and directs the United States District Clerk to submit JS-6 form to the Administrative Office, thereby removing it from the statistical records.
