Order Dismissing Case
ORDER DISMISSING CASE: Aderibigbe Ogundiran filed this lawsuit pro se on behalf of a trust in November 2023. Because a non-attorney cannot represent a trust pro se, plaintiff was ordered on 12/4/2023 to show cause why the case should not be dismissed without prejudice. See 12/4/2023 Order. The Court later granted plaintiff's request that any action be delayed for 45 days so that plaintiff could obtain an attorney to represent the trust. See 2/1/2024 Order. But the Court warned plaintiff that an attorney must file a notice of appearance on the docket by 3/18/2024, and that if an attorney did not do so by that deadline, the case might be dismissed without prejudice. Ibid. The Court further advised plaintiff that "[n]o further extensions will be granted." Ibid. On 3/18/2024, plaintiff filed a request for an additional 45-day continuance. See Letter (Dkt. #8). That request is denied. Because plaintiff is a trust that cannot proceed pro se, and plaintiff has failed to obtain counsel, this case is dismissed without prejudice. See Williams v. Audubon TP4 LLC, No. 23-CV-8758 (LTS), 2023 WL 8528552, at *2 (S.D.N.Y. Dec. 5, 2023). Ordered by Judge Rachel P. Kovner on 3/19/2024. (XW)
