TEXT ORDER: Having held an on the record conference with plaintiff, proceeding pro se, and counsel for defendant, and having heard from the parties concerning the discovery issue raised on the call, it is ORDERED that defendant shall produce to the extent the records still exist: (1) time swipes, (2) crew sheets, and (3) disciplinary records concerning attendance/reporting/timeliness as discussed on today's conference call, all for the period of Nov. 2022 through Feb. 2023 but limited to those days that plaintiff worked. Plaintiff shall cooperate in identifying any dates that he worked to the extent this is helpful in conducting any search. Discovery will remain open through Aug. 31, 2026 solely to address this final outstanding issue. There will be a telephone conference on August 10, 2026 at 1:30 p.m. to set any final case management deadlines and address whether settlement is feasible.
