TEXT ORDER: The parties will recall that at the June 23, 2026 conference, the Court and parties discussed potential terms to resolve this litigation. On or before September 11, 2026, the parties will kindly submit an updated, joint letter concerning the progress of settlement negotiations. Because the letter will contain communications protected by Federal Rule of Evidence 408, the parties may elect to submit it directly to the Court, as opposed to filing it on the docket. The Final Pretrial Conference will resume on October 22, 2026 at 3:00 p.m., in person.
