I. RLA Orders
On June 30, 2026, the Court issued:(1) ORDER GRANTING DEFENDANTS HAWAIIAN AIRLINES, INC. AND HAWAIIAN HOLDINGS, INC.'S MOTION FOR PARTIAL DISMISSAL FOR LACK OF SUBJECT-MATTER JURISDICTION AS TO CERTAIN PILOTS (ECF No. 255 )
and
(2) ORDER GRANTING DEFENDANTS HAWAIIAN AIRLINES, INC. AND HAWAIIAN HOLDINGS, INC.'S MOTION FOR PARTIAL DISMISSAL FOR LACK OF SUBJECT-MATTER JURISDICTION AS TO CERTAIN FLIGHT ATTENDANTS (ECF No. 256 ).
Counts I and III in the Third Amended Complaint were dismissed with prejudice as to 10 pilots and 96 flight attendants.
II. Previously Filed Motions
On October 20, 2026, Defendants filed:(1) Defendants' Motion for Partial Judgment on the Pleadings (ECF No. 102 );
(2) Defendants' Motion to Partially Dismiss Third Amended Complaint (ECF No. 103 ).
The Motions seek judgment as to Counts I and III in the Third Amended Complaint along with other Counts.
On October 28, 2026, in a Minute Order (ECF No. 110 ), the Court held the Motions (ECF Nos. 102 and 103) in abeyance pending resolution of the proceedings in O'Hailpin et al. v. Hawaiian Airlines, et. al., 22-cv-00532HG-WRP and adjudication of the Defendants' two Motions for Partial Dismissal for Lack of Subject-Matter Jurisdiction filed pursuant to the Railway Labor Act, which were ruled on in ECF No. 255 and ECF No. 256 as set out above.
III. Amended Motions And Briefing Schedule
The Court deems the previously filed Motions (ECF No. 102 and 103) withdrawn given the rulings in ECF Nos. 255 and 256.
Defendants are given leave to file (1) an Amended Motion for Partial Judgment on the Pleadings and (2) an Amended Motion for Partial Dismissal as to the remaining Plaintiffs in conformity with the rulings in the Court's June 30, 2026 Orders (ECF No. 255 and 256).
Defendants' Amended Motions shall be filed on or before Tuesday, July 14, 2026.
Plaintiffs shall file their Oppositions on or before Tuesday, July 28, 2026.
Defendants shall file their Replies on or before Tuesday, August 11, 2026.
