Order on Motion to Stay
ELECTRONIC ORDER finding as moot 27 Motion to Stay. Having ruled on the then-pending motion to compel arbitration, the Court finds as moot the motion to stay this case. (Doc. 29 ) Nonetheless, the Court does not intend to set a scheduling order in this action until it resolves any forthcoming motion to compel arbitration. So the only deadlines for this action are Plaintiffs' deadline to file the amended motion to compel arbitration no later July 27, 2026, Defendants' response due 21 days thereafter, and Plaintiffs' reply due 14 days after the response. See Local Rule 7.1(e-f). (Ordered by Judge Brantley Starr on 7/6/2026) (chmb)
Order on Motion to Compel
ELECTRONIC ORDER denying 24 Motion to Compel. Before the Court is Plaintiff Good Samaritan Hospital's motion to compel arbitration. (Doc. 24 ) Good Samaritan Hospital reserved "all rights to respond if the Court requests further briefing" but the motion lacked any evidence or legal arguments. And Good Samaritan Hospital has the initial burden; the Court cannot grant the motion on its conclusory pleading alone. So the motion is DENIED WITHOUT PREJUDICE. Good Samaritan Hospital is granted leave to file a motion with evidence and arguments no later than July 27, 2026. (Ordered by Judge Brantley Starr on 7/6/2026) (chmb)
