MINUTES IN CHAMBERS-COURT ORDER by Judge Percy Anderson. For the foregoing reasons, the Court denies Defendants' Motion to Dismiss as to Count One of the Complaint and grants Defendants' Motion as to Counts Two through Fourteen of the Complaint. The Court dismisses Count Two of the Complaint without leave to amend and without prejudice for lack of standing. The Court dismisses Count Three of the Complaint without leave to amend and with prejudice. With respect to Counts Four through Fourteen, to the extent these claims pertain to ERISA-governed benefit plan(s), the claims are dismissed without leave to amend and with prejudice as preempted by ERISA. To the extent these claims pertain to Medicare Advantage plan(s), the claims are dismissed without leave to amend and without prejudice for lack of subject matter jurisdiction. In addition, the Court strikes Does 11300 from the Complaint. See L.R. 19-1. Defendants shall file their Answer to the Complaint by July 13, 2026.
