The Verified Answer with Counterclaims and each and every Counterclaim set forth therein, shall be, and hereby are, dismissed against Plaintiff, X-Subsea USA, LLC, with prejudice and without costs to any party. The Third-Party Complaint and each claim set forth therein shall be, and hereby are, dismissed against the Alter Ego Defendants with prejudice and without costs to any party. OPSI hereby voluntarily discontinues the Third-Party Action and each and every claim therein against the Non-Settling Defendants without prejudice under Federal Rule 41(a)(1)(A)(i).
