MINUTE ORDER This matter is set for discovery dispute hearing on September 9, 2026. Upon review of the discovery dispute statement, it is clear that the parties have not sufficiently conferred. The parties have listed fourteen disputes. The first two disputes raised by Defendant allege that Plaintiff has not produced certain information. Plaintiff's response is, essentially, "yes we did." The parties need to confer and figure out what, if anything, is actually deficient about the production. Similar "you failed to produce" vs. "we did produce" exist with respect to the second and third issues with respect to Defendant's production. The first issue with respect to Defendant's production is that Defendant has produced insufficient damages information. Defendant responds that it is supplementing the information. Again, the parties need to confer as to whether this supplementation will resolve the issue. With respect to Defendant's allegedly improper privilege log, Defendant essentially responds that Plaintiff likewise produced an improper privilege log and that supplementation is the appropriate remedy. Again, meaningfully confer and figure out what is deficient. These are just a handful of examples. Resolution of the issues raised by the parties, without better conferral, will likely result in a multi-day evidentiary hearing. If the parties cannot resolve some of these issues on their own, and instead require a multi-day evidentiary hearing, then the parties shall be prepared to discuss whether this matter should be referred to a special master.
