Text Order granting in part and denying in part Plaintiff's motion to continue fact discovery (ECF 26 ): In light of the agreement of the parties regarding the extension appropriate for the fact discovery deadline and finding persuasive Defendant's argument that the fact and expert phases should not run simultaneously, the Court hereby modifies the pretrial schedule as follows: Factual Discovery to close by 9/15/2026; Plaintiff Expert Disclosures shall be made by 10/15/2026; Defendant Expert Disclosures shall be made by 11/16/2026; Expert Discovery to close by 12/15/2026; Motions due by 1/15/2027. Because this order is issuing without waiting for Plaintiff's reply, the Court will hear any additional argument regarding the schedule during the hearing to be set for the pending motion to compel.
