Sweazea STRIKING 113 Defendant LHM SWH, LLC's Objection To Plaintiff's Subpoena To JP Morgan Chase Bank, N.A., and STRIKING 114 Defendant LHM SWH, LLC's Objection To Plaintiff's Subpoena To Bank of America, N.A. Defendant's "Objections" do not fall within the kinds of pleadings permitted to be filed. If Defendant wishes the Court to take any action with respect to the subpoenas in question or Defendant's "objections" thereto, it must file a motion. See Fed. R. Civ. P. 7(b) ("A request for a court order must be made by motion."); D.N.M. LR-Civ. 7.1; see also Fed. R. Civ. P 26(c)(1) (motion for protective order); Fed. R. Civ. P. 45(d)(3) (motion to quash subpoena). If Defendant were to file a motion, its "Objections" would then be filed as an attachment to the motion. See D.N.M. LR-Civ. 37.1. But objections to discovery by themselves may not be filed independent of a motion. They must instead "be served," with the objecting party filing "[o]nly a certificate indicating the date of service." D.N.M. LR-Civ. 26.2; see also Fed. R. Civ.
