ORDER that IES Communications' Motion to Dismiss, (Doc. 18 ), is granted as follows: (1) Keith's requests for injunctive or declaratory relief requiring IES Communications to strengthen its data-security systems, submit to future audits, or implement written cybersecurity policies are dismissed without leave to amend. (2) Keith's negligence claim (Count 1) is dismissed with leave to amend. (3) Keith's breach of implied contract claim (Count 2) is dismissed with leave to amend. (4) Keith's invasion of privacy claim (Count 3) is dismissed with leave to amend. (5) Keith's unjust enrichment claim (Count 4) is dismissed with leave to amend. (6) Keith's standalone claim for declaratory and injunctive relief (Count 5) is dismissed without leave to amend. FURTHER ORDERED that any amended pleading shall be filed by no later than 10/21/2026. FINALLY ORDERED that if Plaintiff fails to file an amended complaint by 10/21/2026 the Clerk of Court shall enter judgment accordingly and close this case without further order from the Court.
