JOINT STIPULATION TO STAY LITIGATION AND SUBMIT CASE TO ARBITRATION NOW, THEREFORE, the Parties hereby stipulate and agree as follows: 1. Plaintiff will submit all of her claims asserted in this action to binding arbitration("the Arbitration") per the applicable Arbitration Agreement. 2. The entire action shall be stayed pending the binding arbitration. 3. The court filing date, December 29, 2023, shall be considered the filing date in any arbitration for statute of limitations or any other filing deadline purposes, including, but not limited to claims under Title VII, ADA, the NYSHRL, the NYCHRL, and the FMLA. 4. Infosys Limited, Khanchana Navakiran, and Gagan Jain will be named as Respondents in the Arbitration. Infosys Limited will waive any statute of limitations defenses and/or affirmative defenses as a result of being incorrectly named as Infosys, Inc., as if correctly named at the outset of the stayed action filed on December 29, 2023. 5.The caption in this lawsuit shall be amended to correct Defendant Infosys's name from "Infosys, Inc." to "Infosys Limited". IT IS HEREBY STIPULATED. This action is hereby STAYED. The parties shall file a joint status update on or before November 1, 2024. SO ORDERED. Case stayed.
