Status Conference held on 7/23/2026. The court reviews the status of the case. Discovery is stayed as to defendant K.P.W. pending a ruling on the motion to dismiss. Discovery has been done regarding Avidia, remaining depositions anticipated to be completed on track, experts are not anticipated, and expects to file a S/J motion. The parties agree to the pending motion for protective order. The court will allow the motion with the assent of the plaintiff.
The court addresses the motion to dismiss and whether oral argument is needed or if it can be decided on the papers. The plaintiff requests time to confer with his pro-bono assistance. The court will extend fact discovery deadline to 9/15/26 and set a motion hearing for 9/15/26 at 2:30PM unless oral argument is waived. The parties are to file a status report by 9/15 stating whether or not oral argument is necessary and proposing deadlines should the motion be denied.
