ORDER: This case has been reassigned to the undersigned. The parties did not submit a consent form to maintain this case before Judge Scanlon even though they attended an initial conference before her. If that was a deliberate choice of any party, that is their right, but if it was simply inattention to completing the form, they may submit it by September 24, 2026, and the case will be reassigned back to the Magistrate Judge. Otherwise, the Court will vacate the scheduling order set in Magistrate Judge Scanlon's August 25, 2026, Order. The Court has reviewed the parties' pre-motion letters regarding Defendant's proposed motion to dismiss. See ECF Nos. 22 , 23 . The parties do not request a pre-motion conference. Defendant shall file opening papers in support of Defendant's motion to dismiss on or before September 28, 2026. Plaintiff shall file opposition papers on or before October 28, 2026, and Defendant shall file reply papers on or before November 12, 2026.
